The last resident of an estate due for demolition must pay social landlord Co-op Homes £7,500 in costs after losing a challenge to a possession order.

My London has reported that David McGinty has been told to leave the building in Carnwath Road, Fulham, as the site is due to be redeveloped.

He is the last tenant still refusing to leave and has objected to the alternative accommodation offered on the basis that it lacks to river view he currently enjoys.

At Wandsworth County Court Deputy District Judge Anderson found that, since there will be no enforcement until the new flat is completed, the possession order would be granted. He awarded Co-op Home its costs.

Mr McGinty has previously spoken to the Local Democracy Reporting Service and said: "Being here really helped me; really helped my mental health. I was a community bus driver for a long time and getting back here and watching things like the cormorants and things over years, you develop a sense of being part of nature here.”

Michael Mullin, counsel for Co-op Homes, told the court that much of what Mr McGinty had submitted did not constitute a substantive defence.

Mr McGinty said he would look to appeal the decision and described the associated court costs as “outrageous”.

Co-op Homes has been contacted for comment.
