Horsham District Council has launched a judicial review challenge against the Secretary of State for Housing, Communities & Local Government's decision to grant planning permission for 800 homes on a former golf course.

The council had previously refused permission for the site, citing an unsuitable location and "active travel options".

The Secretary of State later granted outline permission for the development following a report from the Planning Inspectorate.

Horsham is launching its claim on the basis that the inspector "made significant legal errors".

The challenge asserts that national planning policy prioritising development in sustainable locations was misapplied, and that the inspector incorrectly deemed the neighbourhood plan, adopted four years ago, to be out of date.

Horsham is pursuing the legal challenge in collaboration with Active Travel England.

Horsham District Council Cabinet Member for Planning and Infrastructure, Cllr Ruth Fletcher, commented: "After careful examination, we believe the Planning Inspector failed to properly interpret and apply national policy, particularly regarding sustainable development.

"This decision undermines the integrity of the Neighbourhood Plan process in determining that the Southwater Neighbourhood Plan, adopted in 2021, is out of date.

"It is vital for public confidence in the planning system that such matters are scrutinised by the Courts."

A spokesperson said the Planning Inspectorate was "not in a position to comment further" as examinations are still live.

The Ministry of Housing, Communities & Local Government has been approached for comment.
